Terms of Service

Please read these Terms carefully before subscribing to Instalinks services. By activating a plan or using our services, you agree to these Terms. If you do not agree, please do not use our services.
1. Parties and Acceptance
These Terms of Service ("Terms") govern the subscription and use of internet and related services ("Services") provided by INIC Communications Private Limited ("INIC", "Company", "we") under the brand name Instalinks Broadband.
By submitting a Customer Acquisition Form (CAF), activating a plan, or using any of our Services, you ("Subscriber", "Customer", "you") agree to be bound by these Terms in addition to any applicable tariff plans, Fair Usage Policy (FUP), and the Company's Privacy Policy, all of which are incorporated herein by reference.
2. Eligibility and KYC
Services are available to individuals aged 18 and above, and to businesses registered in India. Subscription requires successful completion of the mandatory Know Your Customer (KYC) / Customer Acquisition Form process as mandated by the Department of Telecommunications (DoT). Providing false or incomplete KYC information is grounds for immediate termination of service.
3. Service Plans and Pricing
3.1 All plan prices are exclusive of applicable GST unless stated otherwise.
3.2 Plan speeds are "up to" speeds. Actual speeds may vary based on network conditions, time of day, the subscriber's device and hardware, distance from network equipment, and other factors.
3.3 All home broadband plans are subject to a Fair Usage Limit (FUL). Once the FUL is exhausted within a billing cycle, speeds will be reduced to 1 Mbps for the remainder of that cycle. Unlimited plans are subject to fair use at the Company's discretion.
3.4 INIC reserves the right to revise tariff plans, prices, and inclusions. Changes will be communicated with reasonable notice via SMS, WhatsApp, email, or on our website.
4. Payments and Billing
4.1 Payments are due in advance for the selected plan duration (monthly, quarterly, half-yearly, or yearly).
4.2 Services may be suspended upon non-payment. A grace period, if any, will be communicated at the time of billing.
4.3 Payments are non-refundable except in cases where the Company is unable to deliver the service due to its own fault, in which case a proportionate refund or credit may be offered at the Company's discretion.
4.4 For commercial plans, advance payment is required before service activation.
5. Installation and Equipment
5.1 INIC will arrange installation of the fiber termination point and ONU (Optical Network Unit) at the subscriber's premises. The subscriber must provide safe access for installation.
5.2 Equipment provided by INIC (ONU, fiber cable up to the premises) remains the property of INIC. Damage to such equipment caused by the subscriber may result in replacement charges.
5.3 For commercial plans, the subscriber is responsible for providing their own router, firewall, or switching equipment beyond the fiber handover point.
6. Acceptable Use Policy
The subscriber agrees not to use the Services for:
• Any activity that is unlawful under Indian law, including the Information Technology Act 2000 and its amendments.
• Sending unsolicited bulk communications (spam).
• Hacking, phishing, network scanning, or any activity that interferes with or disrupts other networks or services.
• Hosting or distributing child sexual abuse material (CSAM) — a criminal offence.
• Accessing or distributing content blocked by order of the Government of India or Indian courts.
• Reselling or redistribution of internet bandwidth to third parties without prior written authorization from INIC.
INIC reserves the right to terminate service immediately and without notice for violations of this clause and to report such activity to law enforcement authorities.
7. Service Availability and SLA
7.1 INIC endeavours to maintain 99.9% network uptime. Scheduled maintenance will be communicated in advance where possible.
7.2 In the event of unplanned outages, INIC will use commercially reasonable efforts to restore service within 24 hours. For faults beyond INIC's network (upstream provider outages, natural disasters, force majeure), resolution timelines may vary.
7.3 INIC does not guarantee uninterrupted or error-free service and shall not be liable for losses arising from service interruptions beyond its reasonable control.
8. Suspension and Termination
8.1 INIC may suspend or terminate service immediately without notice for: (a) violation of the Acceptable Use Policy; (b) providing false KYC information; (c) non-payment of dues; (d) direction from a competent legal or regulatory authority.
8.2 Subscribers may request termination by contacting support. Termination requests for pre-paid plans do not entitle the subscriber to a refund for unused periods.
8.3 Upon termination, INIC equipment must be made available for retrieval. Unreturned equipment may be charged to the subscriber.
9. Limitation of Liability
To the maximum extent permitted by applicable law, INIC's total liability to the subscriber for any claim arising from or related to the Services shall not exceed the total amount paid by the subscriber in the preceding 3 months.
INIC shall not be liable for: indirect, incidental, or consequential damages; loss of data, revenue, or profits; or damages arising from the subscriber's use of or inability to use the Services.
10. Intellectual Property
All content on the Instalinks website and any software or tools provided by INIC are the intellectual property of INIC Communications Private Limited. Subscribers may not reproduce, modify, or redistribute such content without prior written permission.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Services shall first be attempted to be resolved through mutual negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Bhilai / Durg, Chhattisgarh.
For regulatory disputes, subscribers may also escalate to TRAI as per the Telecom Consumers Protection Regulations.
12. Amendments
INIC reserves the right to amend these Terms at any time. Amended Terms will be published on this page with an updated date. Continued use of the Services after the effective date of changes constitutes acceptance of the revised Terms.
